Ann Chaitovitz Attorney-Advisor USPTO interviewed Marybeth Peters the US Register of Copyrights and had a interesting discussion at the Future of Music Summit 2007 in Washington. I enjoyed the talk and spoke with Marybeth afterwards. We geeked-out and discussed whether or not the use of a song in a greeting card was a mechanical or an audiovisual work and I shared background and data regarding the pre-cleared online music licensing work that Rumblefish has been up to.
She was very pleasant and knowledgeable.
(In case you were wondering Marybeth is of the opinion that the use of a song in a greeting card IS a mechanical and several compulsory licenses have been submitted/acknowledged by the Copyright office for such purposes)
